These terms and conditions apply to the FDN Life Subscribe & Win 1-Month Accommodation Competition 2020 as featured in any publications and online services that are organized by FDN Life Magazine and FDN Life  (“Publisher”) (or a third party on FDN Life ’s behalf).

By entering the FDN Life Subscribe & Win 1-Month Accommodation Competition 2020 competition entrants accept these terms and conditions together with any specific instructions and terms for such competition which may be mentioned in any electronic messages, or on the website, or communicated to entrants in any other way (“competition information”). Such competition information shall prevail in the event of there being any inconsistency between these competition terms and conditions and any competition information.

FDN Life may cancel or amend any competition, competition information, or these terms and conditions without prior notice.

Competition Entry

The competition is open to all residents of any country in the world. FDN Life may ask competition winners for proof of identity in the form of passport or national identification, and if a competition winner is unable to prove their residency to FDN Life ’s satisfaction, FDN Life reserves the right to select an alternative winner.

The minimum age limit unless specified otherwise in the competition information, is 21-years.

The opening and closing dates and times for entries are as indicated in the competition information. Any entries received before the opening and after the closing of the competition will be invalid and will not be entered into the competition. Member subscription need to be valid until May-June 2020 for entry tickets to stay valid. FDN Life Annual / Exclusive Membership subscriptions cancelled on or before May 2020, will be disqualified from the competition.

By entering the competition entrants warrant that all information submitted by them is true, current, and complete. Competition entrants are required to submit entry tickets as per their subscription type via the online method stipulated by FDN Life. An email invitation will be sent out every month / bi-monthly to entrants who qualify to submit entry.

Any limit on the number of entries a person or household may make will be clearly stated in the competition information. Entries received that exceed this limit will be invalid and will not be entered into the competition. To qualify for the prize Entrants need to subscribe to either the FDN Life Annual Member Subscription, or the FDN Life Exclusive Member Subscription to quality for entry tickets as per their subscription type.

FDN Life Annual- or FDN Life Exclusive Member subscriptions need to be active and valid until the announcement of the winner, May 2020. Cancellation of an entrant’s subscription, whether FDN Life Annual- or FDN Life Exclusive Member subscription before May 2020, will also cancel all and any entry tickets entered into the competition, irrespective of how long the subscription was held.

Entry to the competition may only be made through the applicable method(s) indicated in the competition information. The following terms and conditions will apply where the method is indicated as being available in the competition information. Please keep your proof of payment for your subscription (email).

(a) FDN Life  Competition Only Entry Form (Monthly / Bi-Monthly)

FDN Life will make available an online entry form to submit online entry tickets as per the membership subscription, whichever apply to your membership type, which is 1 x monthly entry ticket submission for every month of your subscription if you are an FDN Life Exclusive Member Subscriber, valid from September 2019 to February 2020, with maximum 6 entry tickets as per length of subscription. Monthly entry ticket submission is not automatic, but can be made on a monthly basis only by Entrant on the FDN Life Website.

In the case of FDN Life Annual Member Subscriber, 1 x bi-monthly entry ticket submission will be applicable, valid from September 2019 to February 2020, with max 3 entry tickets as per length of subscription. Bi-Monthly entry ticket submission is not automatic, but can be made on a bi-monthly basis only by Entrant on the FDN Life Website.

FDN Life Exclusive Member Subscribers / FDN Life Annual Member Subscribers can also refer and earn entry tickets for every new FDN Life Exclusive- or – Annual member subscription they refer to FDN Life. 1 x entry ticket per successfully referral who signs up for either/or FDN Life Exclusive Member Subscription or FDN Life Annual Member Subscription will apply, from the dates of 10 September 2019 to 28 February 2020, and of whose subscription stays valid and active until the announcement of the winner in May 2020. Referrals who cancel their subscription before May 2020 will lose entry tickets, alongside the referee.

FDN Life Free Members CAN NOT refer and earn, and are not eligible to earn referral entry tickets.

Entries received after the notified competition closing time will not be valid. FDN Life accepts no liability for any entries not submitted on time regardless of whether the entry is received before the competition closing time.

Where specified in the competition information as an available method of entry to the competition, web entrants are required to follow the instructions on the website as indicated in the competition information.

Entrants will receive a confirmation email for each entry submitted to the competition. Please keep your entry emails on hand for verification at the end of the competition and to claim prize.

Web entrants may be required to supply their name, and/or email address and/or a contact telephone number and/or any other details.

Only valid FDN Life members in the Annual & Exclusive member type can enter the competition. FDN Life Free Member Subscriptions are not eligible for this competition. Entry tickets from FDN Life Free Member will not be considered and is invalid for this competition.

Employees, staff, journalists or writers of FDN Life are not eligible to enter competition.

(c) Email entry

No email entries will be accepted.

(d) SMS or Mobile Internet entry

SMS and mobile entries will not be accepted.

(e) Entry via Social Network Sites
Entry via social media does not apply and will not be accepted.

Prize

The prize is as specified in the competition information.

The winner will also be featured in the May-June 2020 issue of FDN Life Magazine, and on the FDN Life website, and is therefore required to agree to fill out an online Q&A or if chosen, to do a video call interview with an FDN Life journalist to compile a Spotlight and promotional article about the winner. Winner should be open to submitting promotional photos for inclusion in the article about them. FDN Life reserves the right to select an alternative winner in the event that these requirements are not met.

Prize draw prize will be awarded by FDN Life. Where the winner is from all correct and valid entries, the draw for the winner will take place within 21 days of the date on which the competition closes.

FDN Life will attempt to notify the winner within 21 days after the closing date, or as otherwise indicated in the competition information, and where time is of the essence for such a period as FDN Life shall in its absolute discretion deem reasonable.

Winners need to follow the society and community accommodation rules as applies in India.

He/she will be contacted ONLY via the email address provided when entering the competition. Entrants need to respond to winning email to claim and secure prize within 7-days. If winner fail to claim prize within 7-days, FDN Life will select another winner. If FDN Life is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified and/or provide an address for delivery of the prize, this may result in forfeiture of the prize and FDN Life reserves the right to select an alternative winner in accordance with these terms and conditions and the competition information.

FDN Life may in its sole discretion refuse to provide a prize, or seek its recovery, in the event of non-entitlement under these terms or an entrant’s breach of these terms, FDN Life’s website terms of use, fraud, dishonesty, or other inappropriate or improper conduct including but not limited to the use of technology which enables an entrant to evade charges or entry requirements.

Any entrant who enters or attempts to enter the Competition in a manner, which in FDN Life’s determination is contrary to these terms and conditions or by its nature is unfair to other entrants may be removed from the Competition at FDN Life’s sole discretion.

FDN Life reserves the right to modify, cancel, terminate or suspend the Competition in whole or in part, at its sole discretion, if it believes the Competition is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of FDN Life that could corrupt or affect the administration, security, impartiality, or normal course of the Competition.

FDN Life reserves the right in its sole discretion to withhold delivery of the prize until such proof of eligibility and identity has been confirmed or if such proof is not produced on request or to disqualify the entrant from the competition.

FDN Life shall try to deliver the prize to the winner within 60 days from the date of the draw, unless otherwise specified to the winner. Delivery restrictions may apply. No cash equivalent (where applicable) or alternative prize will be given and the prize is non-transferable and non-exchangeable. However, FDN Life reserves the right to change the prize due to circumstances beyond its control or to offer an alternative of similar value.

In relation to all competitions, the first name and surname of the winner may be published by FDN Life and entrants grant to FDN Life a non-exclusive licence to use and publish their entry in any media for the purpose of announcing the winner. Inclusive of interview material for winner spotlight feature article in the issue of FDN Life Magazine.

Data Protection and Publicity

FDN Life (or any third party nominated by FDN Life) may exercise its sole discretion to use the winner’s (and (if applicable) their companion’s) name, address, and image and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid.

Information, data and the caller line identity (“personal data”) which is provided by entrants when they enter will be held and used by FDN Life and their suppliers and contractors in order to administer the competition.

If entrants call from a withheld caller line identity and do not provide their caller line identity when in communication regarding the competition, FDN Life may use the withheld caller line identity for customer care purposes such as refunds or communications relating to a service e.g. to notify a winner.

Entrants’ personal data may also be passed to their mobile phone network or to relevant regulatory bodies including PhonePayPlus, the police or other authorities in the course of the investigation of any complaints or suspected unlawful activity or where requested by the phone provider in connection with the billing arrangements for the competition. Aggregate, non personal data may also be used for the purpose of undertaking market research or in facilitating
reviews, developments and improvements to relevant services.

By submitting their personal details, the entrant agrees to FDN Life processing those details in accordance with the purposes made known the entrant at the time of collection and in accordance with FDN life’s privacy policy which can be viewed on the FDN Life website.

Any entrant who is entering the competition may opt out of receiving any marketing communications from FDN Life by unsubscribing from FDN Life Marketing emails / newsletters.

Liability

Nothing in these terms and conditions shall exclude or limit FDN Life’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.

Subject to this, FDN Life cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize.

FDN Life is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the competition.

FDN Life cannot promise that the services relating to the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of FDN Life. FDN Life will not be liable in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way.

Standard Terms

In the event that any entrant does not, or is unable to, comply with and meet these terms and conditions and the competition information, FDN Life shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. In these circumstances, any prize(s) won by the entrant may be forfeited and FDN Life reserves the right to reclaim any prize(s) already distributed to the entrant. Any entrant must comply with any directions given to him or her by FDN Life including but not limited to any and all relevant laws, rules and applicable regulatory codes.

The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

Please note that calls may be recorded to ensure that competition entries are captured, for staff training and quality control purposes.
